Tender for a land drilling rig for geothermal wells. The tender is on behalf of 4 different contracting authorities - Viborg Fjernvarme, Skive Kommune, Tønder Fjernvarme og Aabenraa Fjernvarme - who each has separate projects. Drilling locations will be at 4 different places in Jutland, Denmark.
There will be 4 firm exploration wells at 4 different locations and - depending on the outcome of a flow tests - approximately 22 optional wells.
The first exploration well is expected to begin mid August 2011 depending on rig availability.
Due to the amount of wells the tenderer must be able to offer an additional rig if required at a later stage in the project.

III.1)CONDITIONS RELATING TO THE CONTRACT

None, but if the applicant is a consortium all information and statements be provided for each consortium participant.The consortium must point out an agent, who can act on behalf of the consortium. All the participant firms in the consortium must be jointly and severally liable for performance of the contract.

III.1.4)Other particular conditions to which the performance of the contract is subject

1. The contracting authority or its representative reserves the right to make an inspection of the rig before the choice of applicants for prequalification. The tenderer must fill out appendix A regarding rig location for inspection of the rig.
2. The contracting authority or its representative can carry out an on site audit of the rig's HQSE-system which must show that the rig performs according to the standards set out in the HQSE-system. This audit will be in connection with the inspection of the rig.
3. The tenderer must be able to provide a similar additional rig if required later in the project. Therefore the tenderer must be able to supply 2 rigs. The number of rigs available must be specified in appendix A.
4. The Danish Energy Authority must approve the drilling rig. This approvement will not be a part of the prequalification procedure, but this approval will be before entering into a contract.

III.2)CONDITIONS FOR PARTICIPATION
III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if requirements are met: 1. The tenderer shall fill out, date and sign the appendix B, where the tenderer confirms, that the tenderer has not:
a) been the subject of a conviction by final judgment concerning participation in a criminal organisation, corruption, fraud or money laundering;
b) been bankrupt or is being wound up, where the tenderers affairs are being administered by the court or has entered into an arrangement with creditors or has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
c) been the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or adminstration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
d) been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;
e) been guilty of grave professionel misconduct proven by any means which the contracting authorithy can demonstrate.
The tenderer shall furthermore - in appendix B - confirm that the tenderer has:
f) fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which the tenderer is established or with those of Denmark;
g) fulfilled obligations relating to the payment of taxes in accordance with the legal provision of the country in which the tenderer is established or with those of Denmark;
h) not been guilty of serious misrepresentation in supplying the information required or has not supplied such information related to the above mentioned grounds.
If one of the above mentioned affairs are existing, the tenderer is excluded from participation. The appendix B shall be completed by ticking or marking in the related boxes, dated and signed. Lack of information or wrongfull ticking/marking the appendix B deemes the application for prequalification not-conforming and the application for participation will be rejected.
The grounds for exclusion mentioned in paragraph e) and h) shall not be ticked in appendix B.
The tenderer is obliged to provide further documentation of one or several of the paragraphs for exclusion if required by the contracting authority.
2. The tenderer shall fill out the appendix C regarding Consolidation Act no. 336 of 13.5.1997 on limitation of debtors' participation in public works contracts, etc.,which stipulates that, in connection with the purchase of goods and services, the public contracting entity shall demand that any tenderer make a solemn declaration stating to which extent the tenderer has unpaid mature debt to any public authorities in the form of taxes, duties and contributions to social security schemes under Danish law or under the laws of the country in which the tenderer has its registered office.
The tenderer must not have any debts to any public authority of more than 100 000,00 DKK.
The tenderer must complete the appendix C by ticking the boxes, dating and signing the appendix C.
3. If the applicant is a consortium the appendix B and C must be provided for each consortium participant.

The tenderer must provide:
1. A list of the most important - and at least one - comparable contracts/references completed by the tenderer during the last 2 years stating the location, time, name and telephone number of the recipient. The contracting authority reserves the right to check such references.
2. Provision of an electrical or hydraulic drilling rig with:
a) a hookload capability of 250 metric tons;
b) a mud pump capability of 3750 Ipm;
c) a drilling fluid capacity of 200 cubic meters;
d) a 3 000 psi blowout preventer stack;
e) the rig must be equipped with a top drive system.
3. The rig must be fully winterised to be able to operate in Danish winter conditions.
4. The rig shall be able to drill, test and complete 4 firm plus 20 optional geothermal wells to a depth between 2 500 to 3 500 m. (vertical, deviated or horizontal), in the Jutland area. The programme is to drill a 17 ½” hole, set a 13 ⅜” casing at +/- 250 m. Drill a 12 ¼” hole and set a 9 ⅝” casing at +/- 2 000 m. Drill an 8 ½” hole and set a 7” liner at +/- 2 400 m. Then drill a 6” hole and run 5” lower completion to +/- 2 600 m.
5. CV's for qualified crew to perform work at the drilling rig. At least CV's for key personnel such as toolpushers, drillers and assistent drillers are required and those persons must hold valid IWCF-certificate. Copies of the IWCF-certificates must be enclosed. The CV's must show relevant experiences and the keypersons must have strong communication skills in English. The CV's shall be on personnel who shall operate the rig when the drilling starts. Replacement of personnel must be accepted by the contracting authority.

The applicant must register at Viborg Fjernvarmes website www.viborg-fjernvarme.dk under the geothermal procurement giving name and contact information to whom future information can be sent. After registration at this website, the appendix A, B and C will be available. The applicant are responsible for keeping themselves updated with the latest documents.
The applications for prequalification with the required material and appendixes must be sent to Viborg Fjernvarme, Haandvaerkervej 6, 8800 Viborg, Denmark in 2 copies marked "drilling rig - prequalification".
3-5 firms will be prequalified or fewer if not adequate or suitable applicants are received. If more suitable applicants are received than there are prequalified, the selection will be made based on the forwarded documentation on the specifications of the rig, the inspection and the audit of the rig if inspection and audit i is found necessary. the CV's on the crew and list of references. The contracting authorities will aim at selecting applicants who best fulfill the contracting authorities wishes and best competition.

Precise information on deadline(s) for lodging appeals: Complaints about lack of prequalification must be submitted to Klagenævnet for Udbud within 30 days from the day following the day on which the contracting entity has sent notification to the applicants involved. Copy of the complaint must be sent to the contracting authority.
Complaints about not being assigned the contract must be submitted to the Klagenævnet for Udbud within 6 months after the contracting entity has published notice in the Official Journal of the contracting entity has contracted.
